Auxiliary Duties Overview

Auxiliary duties are administrative functions that Justices of the Peace perform upon request, without exercising judicial discretion. Unlike contested cases requiring judgment, these are routine acts performed when statutory requirements are met.

Justices of the Peace are authorized to perform marriage ceremonies within their territorial jurisdiction. This authority extends to the JP’s home parish, any parish within the same Supreme Court district, and parishes without JP courts (except Orleans).

  • Verify marriage license validity
  • Confirm waiting period has elapsed
  • Check for legal impediments
  • Perform ceremony and file certificate

By virtue of office, a JP serves as an ex officio notary within the ward’s territorial jurisdiction. This authority is strictly limited to four functions:

  • Administer oaths and affirmations
  • Notarize sworn statements and affidavits
  • Make protests on negotiable instruments
  • Notarize bills of sale for movable property

Acts outside these authorized functions are null and void.

JPs may notarize title transfer documents for motor vehicles (OMV) and boats (LDWF). This allows citizens to complete sales locally without traveling to state offices.

  • Motor vehicle bills of sale and title assignments
  • Boat and watercraft transfers
  • Odometer disclosures and affidavits

The JP’s role is notarization only — not drafting documents or registering property.
